New: Legal Landscape

Menopause is NOT a protected characteristic under the Equality Act 2010.

However, employers are facing claims relating to sex, age and disability discrimination, as well as failures to make reasonable adjustments where symptoms have a substantial and long-term impact.

From spring 2027, employers with 250 or more employees will be required to publish Menopause Action Plans as part of their Equality Action Plans, showing the practical steps they are taking to support employees experiencing menopause. Organisations of all sizes are encouraged to adopt good practice now.

Most organisations currently have no formal menopause policy, no trained managers, and no clear picture of where their gaps and risks actually sit.

The law has moved faster than workplace practice, and that gap is where the risk sits.

  • Best v Embark on Raw Ltd (2020) — Harassment and comments about menopause led to a successful age and sex discrimination claim Winston Solicitors
