The Legal Landscape
Menopause is NOT a protected characteristic under the Equality Act 2010.
However, employers are facing claims relating to sex, age and disability discrimination, as well as failures to make reasonable adjustments where symptoms have a substantial and long-term impact.
From spring 2027, employers with 250 or more employees will be required to publish Menopause Action Plans as part of their Equality Action Plans, showing the practical steps they are taking to support employees experiencing menopause. Organisations of all sizes are encouraged to adopt good practice now.
Most organisations currently have no formal menopause policy, no trained managers, and no clear picture of where their gaps and risks actually sit.

Shearer v South Lanarkshire Council (2024) — A teacher objected to a transfer after occupational health warned it would worsen her menopause symptoms and mental health; the move went ahead and she was later dismissed. The tribunal awarded over £61,000 for disability discrimination and unfair dismissal HRi
McCabe v Selazar (2021) — An employee was dismissed with discriminatory comments and awarded £20,000 plus interest Winston Solicitors
A v Bonmarche Ltd (2019) — An employee resigned after a lack of support for her phased return, and was awarded £18,000 Winston Solicitors
